Sale and Cancellation Policy

1.Sale Policy

1.1By listing products and services on Plan Your Media website, Seller (Operator) confirms that it is available for sale to the Buyer (Advertisers or Agency) until and unless the product is blocked or already booked for a particular period and the booking information is readily available on the Plan Your Media website.

1.2Any Registered User can book the media sites available for sale for a particular available period. He can do so by completing the transaction by hitting the BUY/PLACE ORDER button at the checkout page after agreeing the payment terms. Payment terms may change at any point in time and will be the sole discretion of Plan Your Media.

1.3By doing a booking on the website, User abides by certain Obligations to complete the transaction as stated under.

2.Obligation to Complete Transactions

2.1If you offer a Product for sale on the Site, you agree to sell such Product to any buyer that (i) offers the listed price (as set forth on the Site), or (ii) offers a price that you accept via the Site or otherwise; provided in each case that such buyer meets the terms of the agreement between you and such buyer relating to the sale of such Product.

2.2If you make an offer on a Product offered for sale on the Site and the applicable seller accepts such offer, you agree to actually purchase such Product in accordance with the terms of the agreement between you and the applicable seller relating to the sale of such Product.

2.3 In the event you fail to purchase a Product in violation of section 2.2 above, we may, in addition to our other remedies, require you to pay, as liquidated damages and not as a penalty, five percent (5%) of your highest offered price on such Product. The parties agree that the foregoing liquidated damages are reasonable in light of the anticipated or actual harm caused by a breach of sections 2.2, the difficulties of proof of loss and the inconvenience or non-feasibility of otherwise obtaining an adequate remedy.

3.Payment and credit Terms

3.1Buyer has the obligation to complete the transaction and payment as per agreed payment terms at the time of booking. Until there has been separate written agreement between Buyer and Plan Your Media, the normal payment and credit terms is applicable as shown in the payment page.

3.1.1Buyer can be extended credit for the balance payment to Plan Your Media, depending on credit worthiness of the Buyer, additional terms/charges as decided by Plan Your Media at the time of extending such credit.

3.1.2In all scenarios, 100% payment needs to be made as per agreed payment terms at the time of booking.

3.1.3Plan Your Media reserves the right to change/alter/withdraw discount or advance payment terms at any point in time at its sole discretion.

3.1.4In cases where credit is extended, late payment beyond credit days will attract interest of 2% compounded per month along with any other applicable late fee, penalty or charges.

3.2Seller (Operator) will be paid after 60 days of successful completion of order through cheque or credit note as the case may be after adjusting any debit balance, cancellation charges, penalties or any liabilities to Plan Your Media or its Users. Plan Your Media will issue only one cheque per Operator each month.

3.2.1For ease of operation and understanding, for orders/campaigns completed in a month, payments will be made by 30th of next-to-next following month until and unless there is a separate agreement between the Seller and Plan Your Media which supersedes the following agreement.

4.Cancellation Policy

4.1 All cancellations whether through Buyer or Seller need to be done online from the Orders Placed panel in Order Management section.

4.2Apart, Plan Your Media with no liability to Buyer or Seller holds the right to cancel the order at any point in time for reasons not limited to

4.2.1Inaccuracies or errors in Product information, Pricing or Promotion

4.2.2Problems identified by our credit and Fraud avoidance department

4.2.3Credentials of the Buyer or Seller
At times we may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your payment has been done, the charged amount will be refunded to you as soon as we can.

4.3A confirmed order on Plan Your Media website cannot be cancelled by the Operator for any given reasons after 48 hours of order receipt. It is the responsibility of the Operator to keep information up-to-date of the available inventory and other related information of the inventory on the website. Operator confirms to honour such confirmed orders. In case the Operator still cancels a confirmed order, Operator confirms that he/she is liable to pay a penalty 2 times the booking amount (including VAS and applicable taxes) to Plan Your Media for such cancellations.

4.4In case of such cancellations, where Operator cancels a confirmed order, Buyer relieve Plan Your Media of any liability or losses whether actual or notional, incurred because of such cancellations. Plan Your Media is liable to the Buyer to the extent of payment received by it against the said booking. In such case, such booking amount will be refunded to the Buyer within 15 days of cancellation date.

4.5The Buyer can cancel its booking at any point in time by paying Plan Your Media with applicable cancellation fee as mentioned in the individual media cancellation policy as decided by the Operator or PYM. The cancellation fee can change any point in time and at the sole discretion of Operator or Plan Your Media. Users are advised to check cancellation charges before initiating any cancellation by visiting the item detail page and clicking Cancellation policy published on the website.
